Barss abandoned his request for Accelerated Rehabilitation -- under which his record eventually could have been wiped clean -- after Blumenthal moved today to oppose it.
Instead, Barss today pleaded guilty to conspiracy to commit 4th degree larceny for the theft of an I-beam from the state. The court sentenced him to a one- year suspended sentence and three years of probation, and ordered him to pay restitution to the state.
By pleading guilty today, Barss avoided the state’s new pension revocation statute, which goes into effect Oct. 1.
“Barss’ betrayal of the public trust made him unfit for the Accelerated Rehabilitation, and I was determined to vigorously fight his request,” Blumenthal said. “I will fight any future requests for special probation from other state employees who abuse their positions to enrich themselves and others. Anyone stealing from the state should be punished, not given a break.
“I am disappointed that the state will be unable to revoke Barss’ state pension. Starting next month, workers convicted of criminal wrongdoing like Barss face loss of their state pensions when they betray the taxpayers. Pension revocation will prove a powerful deterrent against larceny, kickbacks and other crimes, as well as assure taxpayers no longer pay for pensions to those who steal.
“My hope is that restitution ordered as part of his criminal sentence will help compensate for the loss to the taxpayers in this case.
